It is Easier Getting Married Than Divorced

Getting divorced is a lot more complicated than getting married, and it can take months even years before your divorce is final. People divorce for lots of different reasons. Consequently, it’s wise to understand the realities of what a divorce can and can’t do for you. This does not mean that divorce is easy, it can be brutal. The choices you make before you start your divorce are critical.

After all, divorce is a complicated legal process, and it can be full of unpleasant surprises and frustrating delays. Predictability and divorce don’t go together. This pain, disruption, and uncertainty means that recovering from a breakup or divorce can be difficult and take time. A divorce court cannot accomplish an exact or mathematically equal division of property and time with children.

Being mad at the other party, wanting to hurt them and throwing around terms like” For Cause or Fault” can have serious repercussions. The legal grounds for a fault-based divorce are desertion for a year or more, bigamy, adultery, a jail sentence of two years or more for the conviction of any crime, indignities (any continuing conduct which makes the plaintiff s life unbearable), and cruel treatment which is a danger to the plaintiff’s life or health. If a divorce is sought on fault grounds, and the defendant proves that the plaintiff is not innocent or injured, or that the facts claimed by the plaintiff are not true, a divorce may not be granted.

You may think they are cruel or cheating but can you prove it? They are the defendant, innocent until proven guilty. Hearsay does not work. Evidence is the rule, evidence a court will accept.

A divorce is not final until a decision is made and a divorce decree is entered by a court. If Divorce is a Game, you need to know the rules and Divorce Protector is the book every person confronting the challenge of divorce must read. Again, the choices you make before you start your divorce are critical. Even if you only get started with a 24 to 72 hour action plan, you need to think it through and have a plan.

If you are involved in a divorce action, both parties need to consider all factors, custody, alimony, support, marital property, counseling, and attorney’s fees before a divorce is finalized. Can we afford the final number? Many times, both parties are mad, vindictive, ready for blood, and have not realized both will be affected greatly. Most couples do not have excess assets. This is almost always a lose lose, a no-win scenario.

A mediated divorce can range from $7,000 to $10,000 per couple, depending on case complexity. Costs for a standard Lawyer-Driven Divorce can range from $20,000 to $32,000 per side.  A Lawyer-Driven Divorce can take 18 months to three years. Costs for a divorce that goes to trial vary, but can range from $78,000 to $200,000 per couple.

Some see divorce as the cure-all; they hope that divorce will end their unhappiness. Most of the time the reality is very different. While some may be happier after a divorce, research indicates most adults that divorce have lower levels of happiness and more psychological distress compared to married individuals. There is no way to deny or avoid the reality that a high conflict divorce can be emotionally and physically draining. To understand the emotional turmoil, you undergo following a divorce is very difficult.

While divorce may be the reason for your distraction from career and work life, it can also leave an impact on your future opportunities. Opportunities that may never return. If there are children involved, you perhaps legally must stay, not take a promotion, that golden opportunity.

So, yes, divorce is hard, and it’s better to be prepared for it. Divorce is a highly stressful, life-changing event. Each divorce is different and everyone handles their specific experience in their own way.

The legal battle that divorce can be is not something to be started lightly, everyone suffers.
